California Pretrial Bail Reform​

Turning Leaf Inc. is a nonprofit 501(c)(3) public charity and seeks to improve the effectiveness of the criminal justice system and decrease recidivism by providing a quality holistic pretrial assistance program for inmates released on bail. This pretrial diversion program will provide supervision and rehabilitation of defendants through the loving support their families and local community.

Our pretrial diversion program will provide many of these defendants and their families with the support needed to become productive, law-abiding and thriving members of our communities, reduce tax payer dollars spent on prison systems while keeping our communities safe.

The Problem​

The authority of the State is very limited during the pretrial phase of a prosecution due to the Fifth Amendment constitutional right of a defendant to be considered innocent until conviction.

Although the modern criminal justice system offers rehabilitation programs, these do not start until after conviction. The current commercial bail bond system is quite effective at making sure defendants appear in court.

The recent “Humphreys Decision” by the CA Supreme Court demonstrates the courts have been setting bail 5-10 times higher than any other state. This punished the poor and marginalized.
 

Tax-funded programs are expensive, keep many more arrestees detained, and are much less effective than bail at ensuring that defendants appear in court. These systems do not provide support for defendants and their families during the critical and risky pretrial period, and the defendants and their families can be further pushed into poverty, homelessness and recidivism.

The Solution​

Turning Leaf helps indemnitors to leverage a defendant’s motivation to stay out of jail. Defendants agree to a rehabilitation plan aimed at helping them become productive, law-abiding and thriving members of society. Turning Leaf will connect defendants with an indemnitor, a financially solvent family member or friend who will be liable to the State if the defendant fails to appear in court. 

Turning Leaf will partner with  rehabilitative services, such as addiction treatment and anger management, during the critical and risky pretrial period.

Allow defendants to maintain employment or if not employed, engage them community service projects.

Turning Leaf seeks to add an incentive-based element to the existing bail system.
